A stalemate on the 3rd Street Project in Media Borough continues.
As the parties involved in the continued lawsuits and appeals await court decisions regarding the latest in the 3rd Street Project, the board president of Broomalls Lake Country Club says its a matter of 4 feet that is now holding the project up. In September 2012, the majority of council voted to approve a one-lane, one-way roadway over the dam and within two weeks of the vote Broomall's Lake Country Club filed a contempt of court petition saying council violated a three-way agreement between BLCC, the borough and Delaware County. Media Borough Council President Brian Hall gave a brief update as to the status or holding pattern the 3rd Street Project is currently in. In September 2012, after eight months, the majority of council voted to approve a one-lane, one-way roadway over the dam and within two weeks of the vote Broomall's Lake Country Club filed a contempt of court petition saying council violated a three-way agreement between BLCC, the borough and Delaware County, Hall said at council's Thursday meeting. A judge revoked the 2011 three-way stipulation agreement this week, bringing the 3rd Street Project back to almost the beginning.
Common Pleas Court Judge James Proud ruled on Monday to revoke a May 2011 stipulation agreement between Media Borough, Delaware County and Broomall's Lake Country Club. Although the stipulation agreement did not answer the question of "who owns the dam," it did move the project forward in May 2011 after 16 years of litigation. Media Borough was responsible for the repairs to the road while the county and BLCC were to maintain the dam once the repairs were made. Proud's ruling cancels out any progress that was made in the last year. The parties involved with the Contempt of Court Petition filed in the 3rd Street Project are to submit final arguments to the judge.
A hearing was held this week regarding the 3rd Street Project's Contempt of Court Petition and Common Pleas Court Judge James Proud ordered the parties to submit their arguments by Feb. 15. In September, Broomall's Lake Country Club filed a contempt of court petition stating that Media Borough Council's approval of a one-lane, one-way roadway across the 3rd Street Dam, violates the May 2011 three-way stipulation agreement between the borough, Delaware County and BLCC. Delaware County has not joined in the filing of the contempt of court petition however is a party to the petition due to the three-way stipulation agreement. The Rose Tree Media Board of School Directors supports the reopening of the 3rd Street Bridge as a two-way street.
The Rose Tree Media Board of School Directors stated its support for the reopening of the Third Street Bridge to two-way traffic at its meeting Thursday. In September, Media Borough Council voted to communicate its design parameters to the Pennsylvania Department of Transportation of a 28-foot wide, one-lane roadway, going one-way into the borough, with shoulders on both sides, a buffer and a landscape architect to be engaged at 3rd Street in Media. Media Borough residents showed support for the 3rd Street Project compromise at the recent legislative meeting.
Several residents showed support at last week's Media Borough Council meeting for what has been called a "compromise" on the 3rd Street Project decision to create a one-lane, one-way roadway across the dam. Media Borough Council voted 4-3 in favor of a one-lane, one-way roadway across the dam in September as residents continued to sit on both sides of the fence regarding the number of lanes and width of the roadway prior to the vote. The conversation and debate over the 3rd Street Project continues with residents offering opinions and apparently the "sale" of Media Borough Council on Craigslist. Last week, Broomall's Lake Country Club filed a contempt of court petition against Media Borough following its approval of a one-lane, one-way roadway across the 3rd Street Dam. UPDATED OCT. 2: According to attorney Adam Matlawski, representing Delaware County on this issue, the county has not joined in the filing of the petition however is a party to the petition due to the three-way stipulation agreement. "(The county's) understanding (of the stipulation agreement) is that the borough would make the repairs to the roadway," Matlawski said. "Our understanding was that it was to be two-way but as of now the county doesn't have a formal position on it." Media Borough Council voted Thursday 4-3 in favor of a 28-foot wide roadway with one lane of traffic, one-way into the borough over the 3rd Street dam.
Following a heated discussion and confusion over how the 3rd Street Project was to immediately move forward Media Borough Council approved 4-3 a one-lane, one-way roadway across the 3rd Street dam. Council members Dawn Roe, Monika Rehoric and Paul Robinson voted against the motion after another motion to table the issue was also voted down.
