4 Feet Cause 3rd Street Delay, BLCC Rep Says

A stalemate on the 3rd Street Project in Media Borough continues.

As the parties involved in the continued lawsuits and appeals await court decisions regarding the latest in the 3rd Street Project, the board president of Broomalls Lake Country Club says its a matter of 4 feet that is now holding the project up. In September 2012, the majority of council voted to approve a one-lane, one-way roadway over the dam and within two weeks of the vote Broomall's Lake Country Club filed a contempt of court petition saying council violated a three-way agreement between BLCC, the borough and Delaware County. In February 2013, instead of the court ruling on the petition, the judge threw out the original May 2011 three-way stipulation agreement, which required the borough to design, build and pay for the project. 3rd Street Project Awaits Appeal Decision

The 3rd Street Project continues to be in 'litigation limbo,' Media Borough president says.

Media Borough Council President Brian Hall gave a brief update as to the status or holding pattern the 3rd Street Project is currently in. In September 2012, after eight months, the majority of council voted to approve a one-lane, one-way roadway over the dam and within two weeks of the vote Broomall's Lake Country Club filed a contempt of court petition saying council violated a three-way agreement between BLCC, the borough and Delaware County, Hall said at council's Thursday meeting. "(BLCC) was asking the court to force the borough to build a two-lane, two-way road on top of Broomall's dam," Hall said. Judge Revokes 3rd Street Stipulation

A judge revoked the 2011 three-way stipulation agreement this week, bringing the 3rd Street Project back to almost the beginning.

Common Pleas Court Judge James Proud ruled on Monday to revoke a May 2011 stipulation agreement between Media Borough, Delaware County and Broomall's Lake Country Club. Although the stipulation agreement did not answer the question of "who owns the dam," it did move the project forward in May 2011 after 16 years of litigation. Media Borough was responsible for the repairs to the road while the county and BLCC were to maintain the dam once the repairs were made. Proud's ruling cancels out any progress that was made in the last year. 3rd Street Parties to Submit Briefs on Feb 15

The parties involved with the Contempt of Court Petition filed in the 3rd Street Project are to submit final arguments to the judge.

A hearing was held this week regarding the 3rd Street Project's Contempt of Court Petition and Common Pleas Court Judge James Proud ordered the parties to submit their arguments by Feb. 15. In September, Broomall's Lake Country Club filed a contempt of court petition stating that Media Borough Council's approval of a one-lane, one-way roadway across the 3rd Street Dam, violates the May 2011 three-way stipulation agreement between the borough, Delaware County and BLCC. Delaware County has not joined in the filing of the contempt of court petition however is a party to the petition due to the three-way stipulation agreement. As a UP resident living off Highland, I would suggest removal. Save Borough funds, save considerable State tax dollars now and down the line. Seventeen years have proven that this roadway is not necessary to the Borough's good economic health and as far as I know proven that there is no real safety issue presented by lack of the bridge (be it one lane or two or a greenway).   more ›

A Common Pleas Court Judge has asked the three parties involved with the 3rd Street Project to come to a common agreement following a contempt of court filing.

Cindy: Yes, a part of the bridge is in Upper Prov. My point is that Media Borough Council needs to adhere to the wishes of Media Borough voters when bringing plans to the table on the bridge. As Media Patch reported, the number of Media Borough residents who spoke in favor of a two lane / two way traffic solution were both minimal and in the minority. The Friends of Glen Providence Park presented its vision of public safety, minimal environmental impact and community enjoyment for the 3rd Street Project to Media Borough Council.

The Friends of Glen Providence Park presented its vision, principles and key elements for the 3rd Street Project at Thursday's Media Borough Council meeting. The group's vision is public safety, minimal environmental impact and community enjoyment. Borough resident Linda Healy, a member of the Friends group, said this vision is a shared vision of the community shown by both local political parties, project stakeholders and in public opinion surveys. Friends of glen providence did not exixst until bridge was ready to move forward..Should be opened to two way traffic..it will have NO impact on park, same as it did when two lanes were there.Local residents in area want their street to be little or no traffic..pedestrian and Bicycle options can be met with two lanes..gimme a break..now they care about the park..?   more ›

Media Borough Council Approves Replacement of 3rd St. Dam

Media Borough Council voted 5-2 in favor of replacing the existing 3rd Street dam at its Thursday meeting.

Media Borough Council voted on a direction to take the 3rd Street Project at its meeting Thursday night and took the first step of many that will move the project forward after 16 years. Council voted 5-2 in favor of notifying the Pennsylvania Department of Transportation that the direction of the 3rd Street Project be to replace the existing dam with another dam structure that has both a vehicular and pedestrian component, consistent with the three-way stipulation between the borough, county and Broomall's Lake County Club made in May 2011. Councilmen Kent Davidson and Paul Robinson voted against the direction. 'Bare Bones' Vote On 3rd Street Bridge/Dam Coming in May

Media Borough Council told the public it will vote on the "broad direction" of the project at its May 17 meeting.

No decisions will be made on the 3rd Street bridge/dam until the next regular Media Borough Council meeting on May 17, Council President Brian Hall announced at council's meeting Thursday night. The decision in May will likely only give very broad direction as to the nature of the project, Hall added.
